Employees, as affected persons, can apply to have an employer put into business rescue.

Cashflow shortages is a sign of financial distress and the directors of companies need to comply with their Companies Act requirements in relation to informing parties of such distress.

For those registered with trade unions, the union can support the application to ensure employee rights are protected.

Could early business turnaround/rescue interventions have made a difference?

Possibly.

It is noteworthy to mention that employees are affected persons per the Companies Act and as a result can apply to the courts, when there is a reasonable prospect of rescuing the business, to have the business placed under court ordered rescue.

There is power in the law, use it when it is the right thing to do and for the benefit of society at large.

South Africa has seen another 109 business liquidations in the month of April 2025, taking the total number of closures to 482 for the year so far.
