Non-Compliant Trust?

⚠️ SARS Increases Trust Compliance Enforcement

From 4 May 2026, SARS will automatically issue monthly administrative penalties to all non-compliant trusts — including dormant trusts. Penalties can range from R250 to R16,000 per outstanding return and may continue for up to 35 months.

Trustees are legally responsible for ensuring that trusts remain fully compliant, including:

✔️ Submitting annual ITR12T tax returns
✔️ Keeping trust information updated with SARS
✔️ Maintaining accurate financial records and trustee documentation
✔️ Submitting IT3(t) returns where applicable

Non-compliance may result in penalties, interest, and even personal liability for trustees.

If your trust is inactive or no longer in use, it must still be formally deregistered with SARS to avoid ongoing compliance obligations and penalties.

🧾 The EMP501 is a reconciliation declaration that every employer is required to submit.

✅ As part of the reconciliation process, employers are required to submit a complete and accurate Employer Reconciliation Declaration (EMP501), together with Employee Tax Certificates (IRP5/IT3(a)) issued to employees.

To ensure a successful submission, the following three components must reconcile with one another:

1️⃣Monthly Employer Declarations (EMP201) – indicating PAYE, SDL, and UIF amounts declared.
2️⃣Payments made to SARS – excluding any amounts relating to penalties or interest.
3️⃣IRP5/IT3(a) certificates issued – the PAYE, SDL, and UIF values reflected on these certificates must correspond with the EMP201 declarations and payments made to SARS.
