Guys everytime I watch these shows like Mamazala or Kukithi, all those issues wouldn't exist if the person had a Will. It breaks my heart because people should be grieving and not fighting over such things. Let's all sort out our estate while we are still alive so that our families don't need to fight over who gets what.

The Master of the High Court requires an original (hard copy) signed Will when you pass away and your estate needs to be administered. If you passed away today, would your beneficiaries know where to find your Will?

We recommend signing two copies of your Will, sending one to your executor and keeping the other for your records. Most people are deterred by the fact that many institutions charge for the safekeeping of a Will so they never get it done. Many people forget to update their Wills after a divorce which can lead to devastating unintended consequences. The law requires you to update your will within 3 months of your divorce otherwise your ex-spouse might still inherit your assets if you die without updating the will.

By law, people married in community of property each own half an undivided share in all assets in their joint estate.

Yes. Taxes will be payable either as part of the Estate if you sell it before the Estate is finalised, or as Capital Gains Tax on your individual profile if you sell it after you have inherited it.
