Are your trust's tax affairs really in order?

Tune in as Roxanna Naidoo, Director of Global Strategy at Latita Africa, unpacks what SARS's intensified focus on trusts means for trustees across South Africa.

To be discussed:
• Why recurring administrative penalties from 4 May 2026 mark the end of the grace period for trusts
• How improved third-party reporting and IT3(t) data are closing the gaps between trust disclosures and beneficiary declarations
• Why dormant trusts still carry compliance risk, even with little or no economic activity
• What trustees should do now to remain in control before SARS enforces the process

SARS is actively working to educate influencers on their tax obligations and content creators should take note.
Webinars. Videos. Seminars. Rulings. The resources are being made available. The question is whether you're engaging with them.
Here's what you should be doing right now:

• Monitor SARS communications, especially those directed at influencer services
• Treat these resources as your CPD
• Register as a taxpayer or provisional taxpayer if you're receiving consistent income

Tax compliance is not optional. Use the resources available and get ahead of your obligations.

Today, Roxanna Naidoo, Director of Global Strategy at Latita Africa, had the privilege of attending the prestigious IDC and JSE engagement at the Johannesburg Stock Exchange.

It was an honour to be invited into a room with industry leaders, government leaders, decision makers and entrepreneurs focused on growth, investment and sustainable development in South Africa.

For Latita Africa, our work sits at the intersection of business, tax, legal risk and growth. As a tax legal advisory firm, we support businesses in making commercially sound decisions while navigating complex tax, regulatory and compliance environments.

Conversations around funding, investment, enterprise development and economic growth directly impact the advice we give to clients. Understanding the priorities of key institutions such as the IDC and JSE helps us remain aligned with where the market is moving, where opportunities are emerging, and how businesses can structure themselves for sustainable and compliant growth.

We are proud to announce that Roxanna Naidoo, Director of Global Strategy at Latita Africa, has been invited to speak at the South Africa Infrastructure Expo and Transport Evolution Africa (Infra360).

The expo takes place from:

In case you missed it:

Latita Africa's Roxanna Naidoo, Director of Global Strategy joined Kea Boya on Mind Your Money on 93.8 FM to unpack why SARS's stronger collections drive should not send ordinary taxpayers into a panic… but it should absolutely get their attention.

Here is what you need to know:
• SARS is already working with AI, the OECD, and third-party data they know your income type, your medical aid, your pension fund, and your offshore assets before you even open eFiling.
• Ignoring your eFiling profile and only logging in once a year, or only when you are expecting a refund, is one of the most common mistakes taxpayers make.

If you have been putting off your tax obligations, you could be:
• Facing a garnished bank account with no prior warning and no valid excuse of "I didn't know"
• Flagged for a lifestyle audit because what you post on social media does not match what you have declared to SARS
• Sitting with penalties and interest on income that was never declared or declared incorrectly especially if you freelance, run a side hustle, or earn as an influencer.

As Roxanna puts it: "Staying quiet about your tax debt is not going to help anyone. SARS already knows. They were just waiting for you to come to the table."

Something worth knowing if your tax matter goes to dispute.

If SARS estimates an assessment because you were unable to provide the required information, that changes the dynamic entirely.

The estimate is SARS's. When you dispute it, they must be able to justify that it is reasonable.
That obligation sits with them not with you.

Understanding where that obligation sits can be the difference between a poorly contested dispute and a well-prepared one.

The cost of doing nothing can be a lot higher than most people expect.

If your tax residency hasn't been formally resolved, SARS may still treat you as fully taxable in South Africa. That means potential confusion, double reporting, and in some cases exposure to backdated assessments, penalties, and interest.

Tax residency cessation. SARS notification. Formal compliance.

These steps exist for a reason. The longer they are delayed, the more complicated the picture becomes.
Leaving South Africa doesn't automatically end your tax obligations here. Formalising your status does.

If you need assistance with ceasing your South African tax residency, contact us and one of our specialists will be in touch.
