The South African Revenue Service (SARS) has announced Filing Season dates for the 2026 Tax Year!

Understanding the key filing dates and preparing early is paramount to staying compliant.

Key Filing Season Dates:

- Auto Assessments will run from 1 to 12 July 2026.
- Non-provisional taxpayers will have from 13 July to 23 October 2026 to file their returns.
- Provisional taxpayers and Trusts will have until 22 January 2027 to fulfil their filing obligations and avoid unnecessary penalties.

SARS will once again issue auto-assessments to qualifying taxpayers. If you agree with your auto-assessment, no further action is required. However, if you wish to amend the assessment, you will need to submit a tax return within the applicable Filing Season deadlines.

SARS is no longer operating in the dark when it comes to South Africans living abroad.

With the Automatic Exchange of Information framework now fully operational and financial data being shared across more than 100 jurisdictions, SARS has significantly strengthened its ability to identify offshore income, assets, and financial activity linked to South African taxpayers.

Under South African tax law, living abroad does not automatically change your tax residency status. Without formally ceasing tax residency, you may still be regarded as a South African tax resident, with exposure to worldwide taxation and potential Exit Tax implications depending on your asset profile and timing.

A Tax Court judgment in Taxpayer LE (Pty) Ltd v Commissioner for the South African Revenue Service (10 April 2026) has placed “business development” payments in public procurement under renewed scrutiny.

In a R25 billion contract structure, around 20% was routed through intermediaries described as consultants, with no genuine services found. SARS disallowed the deductions, and the Court agreed under section 23(o) of the Income Tax Act. No criminal conviction was required.

The judgment raises key questions about how such arrangements are treated under tax scrutiny.
